These Equipment Alarm Text Messaging Service Terms and Conditions (“Agreement”) govern the use of the automated text messaging notification service (the “Service”) provided by Peak Rentals. The Service sends automated SMS text messages to notify designated employees and customers of equipment alarms, system warnings, environmental conditions, maintenance alerts, and other operational notifications when monitored conditions are met. By providing your mobile phone number to Peak Rentals or enrolling in the Service, you consent to receive automated operational text messages related to equipment monitoring and system alerts in accordance with this Agreement.

Message frequency will vary depending on equipment activity, system status, and alarm conditions. Messages may be sent at any time, including evenings, weekends, and holidays, when monitored conditions trigger notifications. Message and data rates may apply depending on your mobile carrier and service plan. Peak Rentals does not charge users to receive text messages through this Service, but users are responsible for any fees imposed by their wireless carrier.

You may opt out of receiving SMS messages at any time. To stop receiving text messages, you may log in to the notification management portal at https://peakview.rentpeak.com/ to update or disable SMS notification settings, or contact the Peak Rentals corporate office to request removal from the messaging system. After opting out, you will no longer receive equipment alarm notifications via text message. For assistance with the Service, users may contact the Peak Rentals corporate office.

The Service is intended to provide operational awareness regarding monitored equipment but does not replace proper equipment monitoring, safety procedures, maintenance practices, or operational oversight. Peak Rentals cannot guarantee that text messages will be delivered, received, or read immediately. Delivery may be affected by factors including cellular network availability, wireless carrier delays, mobile device issues, signal coverage, or system outages.

Users agree to provide accurate and current mobile contact information and to maintain a mobile device capable of receiving SMS messages. Users are responsible for keeping their phone number and notification preferences up to date. Failure to receive or review a message does not relieve users of any responsibilities related to equipment monitoring, operation, or maintenance.

Mobile phone numbers and related contact information collected for this Service will be used solely for operational notifications and service-related communications. Peak Rentals does not sell, rent, or share mobile phone numbers with third parties for marketing purposes. Information may be shared only with service providers necessary to operate the messaging system or as required by law.

The Service is provided on an “as available” basis without guarantees of uninterrupted or error-free operation. Peak Rentals shall not be liable for any damages, losses, operational interruptions, or other consequences resulting from delayed or undelivered messages, system errors, telecommunications failures, equipment malfunctions, or a user’s failure to receive or respond to notifications. Users remain responsible for appropriate monitoring and operation of all equipment and systems.

Peak Rentals reserves the right to modify, suspend, or terminate the Service or these Terms and Conditions at any time. Continued use of the Service after any modification constitutes acceptance of the updated terms.

By providing your phone number or using the Equipment Alarm Text Messaging Service, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
